Job Description
As Head of Legal and Compliance (L&C) Europe, you will lead the (L&C) function for Europe and assess legal and compliance needs and submit resource plans – develop necessary role profiles, hire, manage the performance of and further professionally develop lawyers and compliance officers (in countries in scope). You will adopt a pro-active, pragmatic and customer-focused approach to implementing strategic business models, driving awareness and effectiveness of legal and compliance issues/requirements (with a particular focus on anti-trust, anti-bribery and data privacy), managing complex transactions and any litigations/government investigations that may arise.
Countries in scope include the DACH Cluster (Austria, Germany, Switzerland,), the Europe Cluster (Benelux, Poland, Nordics and Turkey), France, Italy, Russia, Spain & Portugal, UK & Ireland.
Your key responsibilities include:
• Provide substantive and strategic legal and compliance support to the European Franchise Leadership Teams
• Act as a strategic business partner in all actions relating to the company’s:
o Strategic projects (EFA transactions, pricing and discount policy, maximization of the company intellectual property rights, illegal parallel imports, distributor and other third parties management etc…)
o Contractual negotiations and statutory obligations, including drafting, reviewing and negotiating all legal business transactions with high impact pertaining to the Vision Care and Surgical franchises
• Anticipate and maintain up-to-date knowledge of current laws and industry regulations of the different countries in Europe, to provide strategic advice and foster compliance including with third party distributors (providing regular trainings to ensure that third party distributors operate under the same compliance principles as Alcon for countries in scope)
• Active core member of the International legal and compliance leadership team
• Provide guidance to support the reduction of risks and avoidance of unanticipated disruptions to the business and manage disputes and dispute resolutions in Europe as well as government investigations
• Be responsible for development of, and counsel, on appropriate Alcon’s policies in Europe, including appropriate training of business partners and other Alcon associates
• Supervise any required FCPA, compliance or internal investigations/audits in Europe or its personnel in close collaboration with the Head of Legal and Compliance International, as well as Global Compliance
• Supervise the implementation of global or regional compliance initiatives, policies and training in close collaboration with the Global Compliance Officer.
• Act as a leader and manager to the Attorneys and Compliance officers in Europe, setting objectives, conducting performance reviews and development discussions.
• Oversee and manage the budget for L&C Europe including external legal spend in Europe and ensure that (i) Alcon receives timely, efficient and effective legal advice and representation; and (ii) the legal fees and expenses are reasonable for the services provided
Minimum requirements
What we are looking for:
• At least 12 (twelve) years of relevant legal practice experience and prefer three (3) years of experience in medical device and pharmaceuticals regulations
• Demonstrated ability to counsel effectively from a legal, compliance and business perspective
• Driving Speed and Simplicity/Ownership and Accountability
• Proactive attitude, excellent communication skills (written and oral), management and leadership ability, diplomacy, candour and a willingness to interact with individuals at all levels of the organization on a regional and global basis.
• Law degree and bar admittance or license to practice law in a major European market
• Fluent in English – with a preference for a second language
